PUBLIC CONTRACT FOR THE PROVISION OF HOTEL SERVICESLLC "SOMNUM"
LLC "Somnum", hereinafter referred to as the "Service Provider", represented by Director Gusar Evgeny Tadeushevich, acting on the basis of the Charter, on the one hand, concludes this Contract with any person, hereinafter referred to as the "Customer". The Contract is an agreement on the provision of services on a paid basis, concluded by way of a public offer, and regulates the procedure for providing services - rooms for temporary accommodation at the Petrine 10 hotel, and the obligations arising in connection with this between the "Service Provider" and the "Customer", hereinafter referred to as the "Parties".
The text of this Contract is posted on the website: petrine10.com, in the visitor's corner located in the corridor of the second floor at the address: Grodno, Sovetskaya St., 10. In accordance with paragraph 2 of Article 407 of the Civil Code of the Republic of Belarus, this document, posted on the Internet at petrine10.com, is a public offer, and in case of performance by a natural or legal person (hereinafter also the Customer, Guest) of actions indicating its acceptance, it is binding for the Service Provider and the Customer. In accordance with paragraph 3 of Article 408 of the Civil Code of the Republic of Belarus, payment for services, booking and actual check-in by the Guest is a full and unconditional acceptance of the offer, which is considered equivalent to the conclusion of a contract on the terms set forth in the offer. By paying for services, the Guest confirms that they are familiar with the Rules of Residence and Service at the hotel posted on the website and undertakes to comply with them.
1. SUBJECT OF THE CONTRACT AND PROCEDURE FOR ITS CONCLUSION
1.1. This contract defines the relationship between the Service Provider and the Customer, their rights and obligations, responsibilities related to the accommodation and service of the Customer (their guests).
1.2. At the Customer's request, the Service Provider provides additional services (catering services, etc.).
1.3. This contract is a public contract (Article 396 of the Civil Code of the Republic of Belarus), according to which the Service Provider undertakes to provide services to an indefinite circle of persons (Customers) who have applied for the specified services. Conclusion of this contract is made by the Customer joining this contract, i.e. by accepting (acceptance) by the Customer of the terms of this contract in its entirety, without any conditions, exceptions and reservations (Article 398 of the Civil Code of the Republic of Belarus).
1.4. The fact of acceptance by the Customer of the terms of this contract is booking, check-in, actual stay, as well as payment by the Customer for the services ordered by them in the manner and under the conditions defined by this contract (paragraph 3 of Article 408 of the Civil Code of the Republic of Belarus).
1.5. This contract, subject to compliance with the procedure for its acceptance, is considered concluded in simple written form (paragraphs 2, 3 of Article 404 and paragraph 3 of Article 408 of the Civil Code of the Republic of Belarus).
1.6. Place of service provision: Republic of Belarus, city of Grodno, Sovetskaya Street, 10.
1.7. The Service Provider provides services in accordance with the Rules of Residence and Service at the hotel posted on the website.
2. TERMS USED IN THIS CONTRACT AND THEIR DEFINITIONS
2.1. Hotel - apart-hotel "Petrine 10".
2.2. Service Provider - a legal entity providing hotel services.
2.3. Customer - a natural person ordering and/or using services.
2.4. Hotel services - services provided by the Service Provider for the provision of rooms for temporary accommodation of individuals (guests), as well as additional services.
2.5. Additional services - catering, communication, tourist and other services provided by the Service Provider on a paid and/or free basis in accordance with legislation.
2.6. Checkout time - the time at which the guest must vacate the room (if they do not extend the period of stay) and pay for accommodation. At the hotel, the checkout time is set at 12:00 local time.
2.7. "Full rate" - maximum officially published prices of the Service Provider's accommodation services.
2.8. Request (booking sheet) - a document on the basis of which rooms are booked at the hotel, other services provided by the Service Provider are ordered, and which reflects the specific conditions of the guest's stay.
3. OBLIGATIONS AND RIGHTS OF THE PARTIES3.1. The Service Provider is obliged to:
3.1.1. Accommodate the Customer (their guests) in hotel rooms in accordance with paragraph 1.1 of this contract.
3.1.2. Provide guests with hotel services in accordance with the hotel category.
3.1.3. In case of impossibility to accommodate guests according to the confirmed Booking Request, accommodate them in vacant rooms of a higher class at the cost of the ordered and confirmed rooms, and in the absence of such - in other vacant rooms.
3.1.4. Provide the Customer with information and reference materials that contribute to the formation of the Customer's complete understanding of the hotel services offered by the Service Provider.
3.1.5. Provide the Customer with originals of invoices and copies of documents confirming the fact of provision of services to the guest by the Service Provider.
3.2. The Service Provider has the right to:
3.2.1. Require the Customer's full agreement with the terms of this contract, the Rules of Residence and Service at the hotel when registering accommodation. Without agreement with the terms of this contract and the Rules of Residence and Service at the hotel, refuse to provide services to the Customer.
3.2.2. Unilaterally change the cost of its services based on the economic situation, as well as in case of changes in tax rates, fees, mandatory payments, operating expenses. The price change does not apply to already confirmed and paid bookings.
3.2.3. In the presence of debt of the Customer to the Service Provider for provided hotel services, unilaterally, after notifying the Customer, suspend the accommodation of guests in hotel rooms booked by the Customer until the Customer repays their debt in amounts agreed with the Service Provider, without bearing any property or financial liability to the Customer, or accommodate guests after full payment by them of the cost of hotel rooms at the "Full rate" tariff.
3.2.4. Terminate the contract early in the following cases:
  • violation by the Customer of the Rules of Residence and Service at the hotel;
  • violation of payment conditions for declared services;
  • refusal to agree with the terms of the offer contract and the Rules of Residence and Service at the hotel.
3.2.5. Withhold from the Customer or demand payment of the full cost of services provided or damage caused by the Customer, while the Customer recognizes the actions of the Service Provider as fully lawful and has no claims.
3.3. The Customer is obliged to:
3.3.1. Familiarize themselves with this Public Contract for the provision of hotel services, the Rules of Residence and Service at the hotel, the Policy on the processing of personal data, and other documents related to the provision of declared services.
3.3.2. Provide the accommodation service with identity documents necessary for check-in, fill out the registration card. Submit Requests for the provision of hotel services in accordance with paragraphs 4.1 and 4.2 of this contract.
3.3.3. Pay for the services provided by the Service Provider in the amount, terms and manner established by this contract. The fee for accommodation is charged in accordance with the single checkout time from 12:00 of the current day. Early check-in and late checkout is carried out only by agreement with the Hotel. For early check-in (from 08:00) or late checkout (no later than 00:00) booked in advance and confirmed by the administrator, a fee of 50% of the daily room rate is charged. For accommodation in the room after 00:00, the daily accommodation cost is charged.
Accommodation of children under 18 years of age at the Hotel is allowed subject to their accommodation with parents (guardians) in one room with a separate bed in the room for a fee according to the Hotel's rates. At the same time, no fee is charged for providing a separate bed for children under 3 years of age.
It is possible to accommodate adult Guests in an extra bed in the room for a fee according to the hotel's rates.
3.3.4. When paying for hotel services provided to the Customer's guest by non-cash payment, transfer funds to the Service Provider's account within the period established by this contract. Prepayment for non-cash payment is 100% of the order, unless otherwise specified.
3.3.5. Provide the Service Provider with information about changes in the number of guests, number of rooms and length of stay, as well as declare refusal of booked rooms and other hotel services in whole or in part no later than 24 (twenty-four) hours before the arrival of guests, or no later than three days before check-in - when accommodating more than 10 people. The check-in time at the hotel is set at 15:00 local time.
3.3.6. Comply with the Rules of Residence and Service at the Petrine10 hotel and fire safety requirements.
3.4. The Customer has the right to:
3.4.1. Familiarize themselves with documents confirming the fact of provision of services to the guest by the Service Provider.
3.4.2. Receive booking confirmation within 12 (twelve) hours from the moment of receipt of the Request by the Service Provider.
3.4.3. Monitor the quality of hotel services provided by the Service Provider, and if necessary, make suggestions for its improvement.
3.5. The Customer acknowledges and does not object to the use of video surveillance systems in the hotel premises (except for personal guest rooms and toilet stalls) for security purposes.
4. CONDITIONS FOR BOOKING HOTEL SERVICES
4.1. The basis for booking hotel services (hereinafter booking) is the Customer's Request in free form sent by email; it is also possible to book a room by phone, using messengers.
The Request must contain the following information: surnames and names of guests; country of residence; expected dates and times of arrival and departure of guests; room category; number of people in the room; payer; form of payment; other additional information necessary for quality service of guests.
4.2. Booking is made by phone: +375333377200 or email info.petrine10@gmail.com, through the hotel website petrine10.com, messengers, booking systems indicating persons responsible for booking and their contact details. The Service Provider sends the Customer written confirmation of the possibility of providing hotel services or informs the Customer of the absence of such possibility within 12 (twelve) hours from the moment of receipt of the Request. At the same time, confirmed booking is considered written confirmation of booking with indication of booking number, room category, price, and other hotel services that will be provided by the Service Provider for this Request.
4.3. Booking of hotel rooms for guests by room categories is made in the presence of rooms of the requested category.
4.4. Cancellation and modification of confirmed booking are accepted only in writing by e-mail. Acceptance of cancellation must be confirmed by the Service Provider.
4.5. If the accommodation periods scheduled by the Customer at the hotel or the number of booked places change, as well as in case of booking cancellation, the Customer is obliged to notify about this no later than 24 hours before check-in (before 15:00 of the expected check-in date specified in the request).
4.6. Violation of the booking cancellation/modification period specified in paragraph 4.5 of this section, as well as non-arrival of guests at the Hotel within 12 hours from 15:00 of the expected arrival date, entails payment by the Customer in favor of the Service Provider of compensation in the amount of 100% of the accommodation cost at the rate of each of the cancelled/modified rooms. The Service Provider has the right to withhold the compensation amount from the amount transferred under the Contract as prepayment.
4.7. If the Customer shortens their stay at the hotel and informs the accommodation service staff about this less than 24 hours before the new departure date, the Customer is charged a fee in the amount of 50% of the cost of the remaining period of stay in the occupied room.
5. CONDITIONS FOR PROVIDING HOTEL SERVICES
5.1. When the Customer's guests arrive without prior booking, the Service Provider reserves the right to refuse guests hotel services or provide them after payment at the "Full rate" tariff in the presence of vacant rooms.
5.2. Extension of the guest's stay at the hotel is made if possible. Payment for extension of stay not confirmed by the Customer's request is made by the guest themselves at the "Full rate" tariff.
5.3. Provision of services under this contract for Customers who are individuals is confirmed by the fact of stay, invoice and absence of written claims submitted by the Customer regarding the Services provided by the Service Provider.
6. PROCEDURE, CONDITIONS AND FORM OF PAYMENTS
6.1. The cost of services provided under this contract is determined based on the volume, nature and duration of services ordered by the Customer, according to prices approved by the Service Provider, posted on the website, and in effect directly at the time of issuance of the demand for payment of ordered services.
6.2. The fee for accommodation at the Hotel is charged daily or in full after the provision of services. The Customer has the right to pay for hotel services in advance in full or by making a deposit to the Service Provider's account or make prepayment in cash to the company's cashier upon check-in. The deposit is not a commercial loan.
6.3. The final volume and cost of services provided are determined: for accommodation - at the prices established by the Service Provider in effect on the day of provision of accommodation services (daily); for additional services - at the prices established by the Service Provider in effect on the day of provision of services. Payment currency - Belarusian rubles.
6.4. Final settlement for accommodation and services provided is made by the Customer before 12:00 on the Day of departure according to the invoice in cash or credit (plastic) cards (VISA, VISA ELECTRON, MASTER CARD, CIRRUS/MAESTRO, BELKART, MIR) to the Service Provider's cashier.
6.5. Expenses for bank services for transferring funds are borne by the Service Provider. Advance payment and prepayment are not a commercial loan.
7. RESPONSIBILITY OF THE PARTIES
7.1. The Parties bear responsibility for non-fulfillment, improper and/or untimely fulfillment of their obligations under this Contract in accordance with the terms of the latter, the Rules of Residence and Service at the hotel, and in the part not regulated by the contract and Rules, in accordance with the legislation of the Republic of Belarus.
7.2. The Customer bears responsibility:
7.2.1. for unjustified evasion from final settlement and payment for received services - a penalty of 1% of the unpaid amount for each day of delay;
7.3. The Service Provider bears responsibility for unjustified refusal to provide services according to the request confirmed in accordance with this contract - a fine of 0.15% of the amount of the advance received in the Service Provider's account for this service.
7.4. The Parties are released from liability for partial or complete non-fulfillment of obligations under this Contract if it was a consequence of force majeure circumstances: wars, fires, floods, earthquakes, epidemics, other natural disasters, resolutions and decisions of state authorities and administration, as well as other circumstances assessed as force majeure.
7.5. The Party for which the impossibility of fulfilling its obligations under this Contract arose as a result of force majeure circumstances is obliged, no later than 72 hours from the moment of occurrence of force majeure circumstances, to notify the other Party of this by facsimile, electronic or other communication allowing to record the fact of sending and receiving information (documents) by the Parties. The occurrence of force majeure circumstances must be confirmed by a certificate from the Chamber of Commerce of their country (or other authorized body) certifying the occurrence and duration of force majeure circumstances.
7.6. Non-notification or untimely notification of the other Party about force majeure circumstances deprives the specified Party of the right to refer to any of these circumstances as a basis for its release from liability.
7.7. In case of death of a guest during their stay at the Hotel due to circumstances beyond the control of the Service Provider, the Service Provider bears no obligations related to the execution of documents, burial or sending to the place of burial, neither to the guest's relatives nor to the Customer.
7.8. In case of damage caused by the Customer to the property of the Service Provider or property of third parties on the hotel premises, the Customer is obliged to compensate for the damage caused or losses incurred (Article 14 of the Civil Code of the Republic of Belarus), including the full market value of the property determined on the day of payment, as well as lost profits.
8. DISPUTE RESOLUTION PROCEDURE
8.1. All disputes or disagreements arising from this Contract or in connection with it will be resolved by the Parties through negotiations. In case of impossibility to resolve disputes and disagreements through negotiations, they are subject to consideration in the court of the Grodno region in accordance with and with the application of the legislation of the Republic of Belarus.
9. OTHER CONDITIONS
9.1. This contract comes into force from the day of crediting the advance payment towards payment for the Service Provider's services to the Service Provider's account and is valid until the Parties fully fulfill their obligations under this contract.
9.3. The Parties maintain confidentiality with respect to all information received by them in connection with the conclusion and execution of this contract, and will do everything possible to prevent unauthorized disclosure of the received information.
9.4. The Parties unconditionally agree to consider the Customer's details as the information specified by them when placing an order for the provision of services.
